《澳洲人報》(The Australian)報道,有澳洲重量級律師擔當顧問的「中澳法學交流基金會」,一直被其主席、澳籍華裔律師馬恩國用來在香港宣傳具爭議性的中國政府政策。

馬恩國最近把「中澳法學交流基金會」的名字刪除了「中澳」兩字,改為「香港法學交流基金會」,以釐清該會代表何人。基金會有多名受尊重的澳洲律師當顧問,包括澳洲法律改革委員會(Australian Law Reform Commission)和澳洲傳媒議會(Australian Press Council)前主席David Weisbrot。

報道稱,馬曾稱澳洲為「兩黨獨裁」的國家,他上月以該基金會主席身份在香港的電台節目上說:「如果你認為像澳洲和美國這樣兩黨獨裁的國家是惟一正當的制度,你就錯了。你仍活在過時的西方壟斷年代……在今日的世代,你可以看到中國不但經濟上非常進步,還有保護環境和其他方面,這對整個世界都有利。」

此外,馬曾是親北京政黨民建聯的成員,以及山西省政協委員。他經常傳達北京高官的訊息,包括促進人們更尊重中國國歌的政策。他曾責罵香港立法會前議員梁國雄「(你)甚至不是fucking中國人」。

報道稱,馬恩國更改基金會名稱,令北京政府和香港公眾不再認為他代表澳洲,「當我到中國做法律交流……很多部門都要當作外交事務處理,(但)我們不是外國人,我們是香港公民……香港人(也)感到混淆,因為(他們覺得)為何澳洲人走來評論香港事務。故此,他們會覺得我們仍是外國人。」

馬恩國表示,基金會不代表澳洲律師的觀點,「這個組織的目的,是(令人)更加認識中國。」

《澳洲人報》報道,澳洲外交及貿易部已獲通知有關基金會的事。基金會著名顧問David Weisbrot教授沒有回應該報的查詢。該會其他顧問包括律師Keith Chapple和Greg Jones,以及紐省前上議員何沈慧霞。(Wah)

Australians part of Beijing-backing body

An outspoken Australian-­Chinese barrister has been promoting controversial Chinese government policies in Hong Kong through a foundation ­involving prominent Australians.

Lawrence Ma, who has called Australia a “dual-party dictatorship”, recently dropped the word “Australia” from his China-­Australia Legal Exchange Foundation after confusion over who the group was representing.

Respected Australian lawyers are listed as consultants with the organisation, including professor David Weisbrot, who is a former chairman of the Australian Law Reform Commission and the Australian Press Council.

Mr Ma, a well-known commentator in Hong Kong and head of the foundation, targeted Australia on a Hong Kong radio ­station last month.

“If you think dual-party ­dictatorship in countries like Australia and the United States is the only legitimate system, you are wrong. You are still living in the era of outdated Western dominance,” said Mr Ma, speaking as chairman of the China Australia legal group. “In this era you can see that China has progressed so well economically, as well as protecting the environment and other things which will benefit the whole world.”

Mr Ma previously was a member of the pro-Beijing conservative political party DAB and is a member of the Shanxi Chinese People’s Political Consultative Conference, a regional advisory body to the Chinese government.

He often passes on messages from senior Beijing officials, including policies to foster more respect for China’s national anthem.
Mr Ma also famously suggested pro-democracy politician “Long Hair” Leung Kwok-hung was “not even a f..king Chinese” in a heated exchange over his pro-Beijing advocacy. Mr Ma also has advocated against China’s adopting the separation of powers ­common in democracies, and he backed anti-independence laws.

He told The Australian his foundation would change to ­become the “Hong Kong Legal Exchange Foundation” so Beijing and the Hong Kong public did not think he represented Australia.

“When we go to China to conduct legal exchanges … many of the departments will have to deal with it as a diplomatic event, (but) we are not foreigners, we are Hong Kong citizens,” he said.

“(Also) people in Hong Kong are confused because (they think) why are Australians coming to comment on Hong Kong matters. So in that regard, they would have thought we are still foreigners.”

Mr Ma said it was clear that the foundation did not represent the views of Australian lawyers. “It is an organisation for the purpose of understanding more about China,” he said.

The Australian understands the department of Foreign Affairs and Trade was recently informed about the foundation.
Professor Weisbrot did not ­respond to a request for comment.

Barristers Keith Chapple and Greg Jones also are listed as consultants, as is former NSW Liberal politician Helen Sham-Ho.
Veteran Chinese politics analyst Willy Lam, a professor at ­Chinese University of Hong Kong, said Mr Ma had become known for “defending Beijing’s ­increasingly tight policies towards Hong Kong”. “Beijing can count on him as a reliable defender of their increasingly draconian policies towards Hong Kong,” he said.

“When the Communist Party is pushing policies, they need to ­orchestrate support from different sectors of the community — particularly wealthy businessmen and in some cases professionals.”

Last year Mr Ma led a delegation to Beijing to meet Basic Law Committee vice-chairman Zhang Rongshun. On returning to Hong Kong, he said Mr Zhang had said Beijing would respond with “guns and cannon” to any push for independence in Hong Kong.
